This agreement constitutes a contract between the individuals as mentioned in the reservation form from www.vilanoria.do hereafter called Guest(s) as specified in our Booking Form received from our Website www.villanoria.do.  And Mr. H. de Koning, Rommelhaven 15, 8861 AC, Harlingen, The Netherlands, as agent to the owner.

Please read this Holiday Letting Agreement thoroughly. Any money received by the agent for occupancy of holiday properties VillaNoria Blanca / VillaNoria Azul and/or VillaNoria Verde indicates the acceptance of the terms and conditions of this Holiday Letting Agreement. It is the responsibility of the Guest(s) to be familiar with all policies within this agreement. This letting agreement is entered into by and between the tenant, hereinafter referred to as “Guest(s)”, and Mr. H. de Koning, as agent to “Owners”.

It is agreed that the Owners will let and the Guest will take the furnished premises VillaNoria Blanca / VillaNoria Azul / VillaNoria Verde at La Noria, Coson, Samana, Dominican republic, hereafter called The Premises as set on the Booking Form.

  1. RESERVATION REQUIREMENTS
    1.1 Reservations are not considered “guaranteed” until a signed Holiday Letting Agreement and payment of 50-100 % of the total rental fee including tax or any additional items as per this Agreement are received by Owners.
    1.2 Reservations consisting of two or less rental nights or reservations booked 14 days prior to arrival date will require payment in full on reservation date.
    1.3 Reservations consisting of three or more rental nights require 50% payment of rental fees and the remainder is due SIX WEEKS prior to the arrival date to secure the rental property.
    1.4 If you would like the payment to be charged to a credit card for a reservation consisting of two or less rental nights or a reservations booked 14 days prior to the arrival date, the Owners will automatically charge the credit card if no other prior arrangements are made by Guest.
    1.5 The Guest must be over twenty-one years of age.
  1. PAYMENT AND ACCEPTED FORMS OF PAYMENT
    2.1 A 50% of the total letting fee as deposit is due on confirmation and the balance is due payable in full 6 weeks prior to the arrival date. By paying the deposit and/or the letting fee the Guest(s) declares to accept this agreement and terms and conditions
    2.2 The letting fee will be mentioned in the Owners confirmation, including the deposits and payment methods / bank details.
    2.3The following are the only accepted forms of payment bank transfer, pay-pal or cash. Bank details can be found in the attachment.
  1. CANCELLATIONS AND RENTAL REFUND GUARANTEE
    3.1 Cancellations must be received in writing (by post, email or fax)
    3.2 The date the notification of cancellation is received will be considered as the date by which this following refund policy is established.
    3.3 Rental payments are NOT REFUNDABLE if the cancellation is received less than TWO WEEKS prior to arrival date.
    3.3 TEN PERCENT of full rental rate is refundable if the cancellation is received between TWO TO THREE WEEKS prior to arrival date.
    3.4 TWENTY-FIVE PERCENT of full rental rate is refundable if the cancellation is received between TWO TO FOUR WEEKS prior to arrival date.
    3.5 FIFTY PERCENT of full rental rate is refundable if the cancellation is received between SIX WEEKS prior to arrival date.
    3.6 It is extremely unlikely we will have to make changes to your property rental reservation. However, we may be forced to make changes occasionally, and we reserve the right to do so at any time. Most of these changes would be minor and we will advise you of them as soon as they may be applicable. If we are forced to cancel the property rental because of force majeure or for any reason that makes the property unfit for rental, you will have the choice of either allowing us to try to locate a suitable alternative property on your behalf or of cancelling the booking and accepting a full refund of all monies paid to us. We are not liable for any consequential loss or incidental expenditure resulting from the cancellation of your holiday.
  1. SECURITY DEPOSIT
    4.1 A fully refundable 150 USD (hundred fifty US dollars) Security/Damage deposit is required at check-in, and must be cash. The refund is conditioned to the following circumstances.
    4.2 This security deposit will be returned at the departure date and time provided proper checkout procedures are followed, and there is no breakage or damage to the premises, furniture and only if the premises are left in a tidy and proper state and condition in accordance to the provisions of this Agreement and all keys have been returned.
    4.3 This security deposit will also only be returned if there are no breaches of the Guest’s obligations as established on this Agreement.
  1. CONFIRMATION OF RESERVATIONS
    5.1 Confirmation of the reservation will be emailed or faxed to Guest upon receipt of the reservation advance payment.
    5.2 Please read the confirmation for accuracy of dates, mailing address, number of adults and/or children and accommodations. Any errors must be directed to the reservations department immediately.
    5.3 On receipt of our confirmation you must advise us if anything appears to be incorrect. The Owners regret they are not liable if they are not notified of any inaccuracies within 10 days of our dispatching the documents to you.
    5.4 We reserve the right to refuse a booking at our consideration, without a reason and at anytime.
  1. REFUND POLICY
    6.1 Owners cannot guarantee against mechanical failure of air-conditioning, TVs, Satellite Receivers, VCRs, or other appliances. Please report any inoperative equipment to our office immediately. Owners will make every reasonable effort to have repairs done quickly and efficiently.
    6.2 There will be No refunds nor rent reductions will be made due to failure of appliances or equipment.
    6.3 There will be No refunds for early departures (less days than reserved).
    6.4 There will be No refunds for delayed arrival.
    6.5 There will be No refunds for reducing the number of nights reserved.
    6.6 There will be No refunds for power cuts.
  1. FORCE MAJEURE
    7.1 Owners shall NOT be liable for events beyond their control, which may interfere with Guest(s) occupancy, including but not limited to Force Majeure, acts of governmental agencies, fire, strikes, war, or inclement weather. NO REBATE OR REFUND will be offered in these circumstances
  1. AGE AND BEHAVIOR REQUIREMENTS
    8.1 Guest(s) under the age of TWENTY-ONE YEARS OF AGE unaccompanied by a parent or legal guardian will not be permitted to register and will lose all funds paid to Owners.
    8.2 Any reservations made under false pretences will result in loss of advance payments and possible removal of guest from rental unit. No House Parties are allowed.
    8.3 Property must not be used for any illegal or immoral purposes.
    8.4 Playing any musical instrument or sound production equipment is not allowed between 11.00 PM and 7.30 AM so as to be audible outside the Premises.
    8.5 Owners or their agents have the right to access the Premises to deal with any maintenance or security issues at anytime.
    8.6 Smoking or the use of illegal drugs or permitting smoking or using illegal drugs inside or on the Premises is not allowed.
    8.7 Guest(s) are not allowed to make any alterations, additions to the interior or exterior of the Premises or to the decoration, fixtures or fittings of the Premises or the furniture.
    8.8 Guest(s) are obliged to keep the furniture, soft furnishings and equipment in their present state of repair and condition and to replace with similar articles of at least the equivalent value and standard, any items of furniture which may be found to be missing or destroyed (reasonable wear and tear excepted).
    8.9 Guest(s) are requested not to remove any of the furniture from its present position in the Premises.
    8.10 Guest(s) are not allowed to affix any poster or placard to the interior or exterior of the Premises.
    8.11 Guest(s) are not obliged to do or permit to be done anything which may be a nuisance or annoyance or cause of damage to any neighbouring or adjoining property.
    8.12 Guest(s) are not allowed to do anything or permit anyone else to do anything to be done as a result of which any policy or insurance held by the Owners on the Premises may become void or voidable or subject to an increased rate of premium.
    8.13 Guest(s) are not allowed to have pets inside the Premises.
  1. ARRIVAL CHECK-IN
    9.1 CHECK-IN TIME is after 3:00 PM – Check-in takes place at the Premises office. We may be a little flexible on this, provided there are no departures from the night prior. Please check with us within a few days prior to your arrival date, and when possible, we will be happy to oblige.
    9.2 Keys are NOT available until the property is ready for occupancy. No exceptions to this policy will be made. Owners will use reasonable efforts to have the rental property ready for the Guest(s) occupancy at check-in time, but Owners cannot guarantee the exact time of occupancy.
    9.3 Please call in advance if you may be arriving after 9:00 PM, so that arrangements can be made for Guest property keys to be picked up.
  1. DEPARTURE CHECK-OUT
    10.1 CHECK-OUT TIME is before 11:00 AM. Check-out takes place at our office, and it is strictly enforced so that Owners has adequate time to prepare the property for the next guest. Please return keys before leaving. Guests who do not vacate the rental property and return the keys by 11:00 AM without the consent of the Owners are subject to a fee equal to ONE (1) rental day.
    10.2 Owners can be a little flexible on this, provided that there are no imminent new arrivals. Please check with us, and when possible we will be happy to oblige.
  1. MAXIMUM OCCUPANCY
    11.1 At all times, the maximum occupancy is the number the UNIT sleeps, including infants.
    11.2 Occupancy limits are in accordance with rules and your party must not exceed at any time the numbers of sleeping places, as sleeping limit shows for the individual unit, as for instance: “sleeps 6: 4 + 2”.
    11.3 Only the named guests are permitted to use or stay in the property. If you are expecting overnight visitors, you must let us or our representatives know.
    11.4 The Owners or their representatives have a right at all times to refuse access to the property for people who are not members of the party.
    11.5 If you bring in extra guests or visitors without prior approval and payment, Guest(s) will be asked to vacate the property and any security payments and all rent will be subject to forfeiture.
    11.6 Absolutely No House Parties Allowed!
  1. FURNISHINGS
    12.1 Furnishings are subject to change without notice. Furniture, bedding, mattress pads, utensils or any other property supplied with the rental property must not be taken out or transferred from one property to another.
    12.2 Loss of these items, as well as damage to the property or furnishings in excess of normal wear will be charged to the Guest(s).
  1. ITEMS GUEST(S) MUST PROVIDE
    13.1 Any personal articles, any food and drink items, coffee filters, paper towels,napkins, foil, videos, and a good book. Extra towels for pool usage are recommended.
  1. LINENS
    14.1 A basic supply of linen is provided in each property. Bed linen and bath towels are changed during your stay. The start-up set of bath soap, toilet tissue, paper towels and trash bags will be provided.
  1. PETS
    15.1 You acknowledge that NO PETS are allowed in or on the premises unless Owners has expressly authorised such use.
    15.2 Unauthorised occupancy of pets will result in a 200 EURO fine, immediate eviction and loss of all rents and security payments.

  1. PEST CONTROL
    16.1 Many different pests live and thrive in this region. All units have been professionally treated by a commercial pest control company with precise and complete preventative treatments in an effort to keep all the pests and bugs outside. Should Guests experience a pest control issue, please contact guest services, so Owners may attempt to eradicate the problem. 
  1. INSURANCE
    17.1 It is the responsibility of the Guests to ensure that their personal health and possessions are insured. We do not accept any liability for theft of, loss of or damage to personal possessions or injury.
    17.2 We also recommend that guests arrange adequate travel insurance for cover in case of cancellation, health care or repatriation.
  1. COMPLAINTS
    18.1 Complaints must be reported immediately to the Owners of the property or to their representatives thereby giving them the opportunity to rectify the problem during your stay.
    18.2 If the problem cannot be rectified during your stay, the Guest must write to the Owners within 4 days of departure giving full details of the Guest’s complaint. Owners cannot accept complaints if Guests have not followed the course of action laid down in this clause.
  1. LOCATION MAP & DIRECTIONS AND KEY COLLECTION
    19.1 A Location Map & Directions with Key Collection instructions will be sent to the Guest on receipt of deposit payment.
  1. USE OF AIRCONDITIONING
    20.1 VillaNoria Azul and VillaNoria Verde have optional air-conditioning available in the bedrooms. Guest can make use of these, but the electricity consumption will be charged separately and in addition to the rental rate.
  1. FLOORS
    21.1 By accepting these terms and conditions, the Guest(s) declare(s) that he/they is/are aware the floors of the property might be slippery when wet or walked with wet feet. The Owner is not liable nor accepts any responsibility for accidents due to walking on wet floors or with wet feet.
  1. LISTING AND PRICING
    22.1 Information regarding individual listings is believed accurate but cannot be guaranteed. The Owners have made every effort to ensure that all the information on Owners’ website(s) is current and accurate. Rates, furnishings, fees, and taxes are subject to change without notice.
  1. INDEMNIFICATION AND HOLD HARMLESS
    23.1 Guest(s) agree to indemnify and hold harmless the Owner for any liabilities, theft, damage, cost or expense whatsoever arising from or related to any claim or litigation which may arise out of or in connection with Guest(s) use and occupancy of the rental property including but not limited to any claim or liability for personal injury or damage or assault, theft of property which is made, incurred or sustained by Guest(s).
  1. VIOLATION OF AGREEMENT
    24.1 If Guest(s) violates any of the conditions of this Agreement, Owners may terminate this Agreement and enter premises. Upon notice of termination of this Agreement, Guest(s) shall vacate the Premises immediately and forfeit all rents and security deposits.
  1. CREDIT CARD AGREEMENT
    25.1 The Guest will provide a credit card number as a guarantee of payment to Owners. Guest(s) agree to pay all rent and charges related to property rental. Guest(s) accept all terms of the lease agreement and accept all liability for rent and charges related to property rental, as well as any damage beyond normal wear and tear during the term of my lease with Owners.
    25.2 Guest(s) understand that these costs will be charged to the Guest’s credit card in the absence of another payment arrangement, and the Guest authorises Owners to charge the Guest’s credit card for payment of these items.
    25.3 Owners may use any funds received from the Guest(s) upon Owners’ receipt of such funds.
  1. BANK ACCOUNT
    26.1 All payments other than credit card payments must be made to one of the bank accounts mentioned in the confirmation email.
  1. CONTRACT
    27.1 This agreement is made on the basis that the Premises are to be occupied by the Guest for the purpose of a holiday let only and that the guest occupied the Premises solely on this basis and that this Agreement shall take effect as a holiday letting agreement only.
    27.2 A binding contract comes into existence when the Guest(s)’s booking is confirmed by email by the Owner.
    27.3 The terms and conditions of this contract become into force and are considered to be accepted upon transfer by the Guest(s) and receipt by the owners of the first down-payment.
    27.4 This contract is governed by English Law. It is mutually understood and agreed that any dispute, claim or any other matter that arises out of this contract will be dealt with by the courts of England and Wales.
